This agreement is entered by and between Richelle & Jody Stevens: Willow Creek Kennel. (hereinafter "WCK") and _________________
(hereinafter "Adopter"). In consideration for receiving the dog described herein, I/we expressly covenant and agree to the following:
1) I/We have never been charged with cruelty to animals.
2) I/We agree that the dog will be housed indoors or have adequate shelter outdoors within a confined area and will receive all care
and attention necessary to ensure its health and well being. This includes the provision at all times of sufficient premium brand dog
food, water, exercise, and medical care, including but not limited to heartworm preventative, vaccinations, worming, grooming when
needed, and nail cutting. Adopter also certifies that their property is fenced and if adopter moves, the new property will be fenced prior
to the dog entering the property. If an exception was made at the beginning, that exception no longer applies to any future residence.
Invisible fence MUST be pre-approved in all cases. Invisible fence is not considered adequate fencing as other dogs can enter
your property and attack your dog.
3) I/We agree that under no circumstances will the dog be off lead except when inside house, building, etc. or in a fenced area.
4) I/We agree that all medical records (other than routine vet checkups) will be mailed to WCK within thirty (30) days of
Veterinarian visit for a period of one (6) months after the adoption or until after the dog is altered.
5) I/We agree that the dog will not be abused in any manner. The dog will not be chained, roped or otherwise tethered at any time,
nor will it be permitted off the property of the Adopter unless accompanied by a mature individual. I/We agree that the dog will not
be left outside unattended at any time. The dog will not be trained or used for attack or for guarding property, and will never be used
in any aspect of dog/animal fighting or other illegal practices. The dog will not be the subject of, nor subjected to any biological,
chemical, psychological or other experiments, nor shall the dog be subjected to shock collars or other cruel means of training.
6) I/We expressly agree that the adopted dog shall not be subjected to any form of cosmetic surgery other than alteration.
Unless medically necessary, there will be no removal of dew claws. Under no circumstances shall there be removal of a rescue
microchip (if one is in place). Dogs purchased as PETS may have one or more disqualifying faults, and shall not be bred.
7) Pets will be sold with Limited AKC Registration or as Purebred without papers and must be spay/neuter by age 6 months.
Proof of surgery is required. Alteration due date: ___________. Under NO circumstances are WCK dogs allowed to be bred
without prior consent!!!
Failure to comply with alteration by date listed will result in return of the dog and all accompanying paperwork related to the dog
without any further compensation and at buyer‘s expense.
8) I/We recognize that, although WCK has made every possible effort to provide a dog which is compatible with the Adopter's home
environment, WCK does not warrant the temperament or behavior of the dog, and will not be liable for any acts of the dog while living
with the Adopter, nor for any costs, expenses or damages incurred as a result of the dog's conduct.
9) I/We will keep the pet for so long as it shall live and will not transfer the ownership or custody of the dog to any other person or to
any business or organization other than the WCK except for the purposes of veterinary treatment and/or temporary lodging of the animal
while Adopter is temporarily away. This agreement shall be waived if the adopter contacts WCK and gets concent to do so. The Adopter
expressly covenants and agrees that they will not euthanize the dog without prior approval from WCK.
10) I/We agree to comply with all state and local laws and ordinances related to the keeping of this dog, including licensing and leash
laws.
11) At no time will the dog be allowed to ride in the open bed of a pickup truck
12) I/We will see that this dog wears a collar and ID tags at all times. If the dog has been micro-chipped by WCK. no attempt shall be
made by the adopter to transfer the microchip to another party, or alter the chip in any manner. An attempt to transfer or alter the
microchip will be an immediate breech of contract.
13) This dog is presumed to be in healthy condition. The WCK will not be responsible for any conditions for which clinical symptoms
are not in evidence at the time of adoption.
14) If for any reason, the dog cannot remain with us, we will immediately return it to WCK.
15) I/We understand that the adoption deposit of $500 is non-refundable. This fee is required to hold a specific puppy. If a deposit is
placed prior to the puppies birth, it is recognized that the deposit does not guarantee a specific gender, color or coat type. However,
if a deposit is placed and the party placing the deposit is not satisfied with the gender, color, coat type of the pups once they are born,
any fees paid will not be returned, but can be applied to a future litter (no longer than 1 year) with the agreement of buyer and seller.
These fees will go toward the care, boarding, and advertisement of the puppy until a new home is found.
16) I/We understand that this dog will be given a clean bill of health (free of any normal health problems that can be diagnosed by a
physical exam and fecal exam) by a certified veterinarian 1-2 days prior to the litter’s scheduled release date and all documents proving
this to be true will be provided to the adopter by WCK.
17) I/We understand that it is the buyer's responsibility to have the dog examined by a vet within 3 business days of receipt,
to provide assurance of good health and as a base line for future veterinary reference. If, during this period, the dog is determined
by a certified veterinarian to have any debilitating or life threatening condition of prior or preexistence, it can be returned for a refund of
all moneys paid, (including) shipping. If a replacement dog is requested and available under the condition mentioned above in section 15,
the original dog will be shipped back to the breeder. The breeder also agrees to pay 50% of the shipping cost for the replacement dog to
be shipped. The replacement dog will be shipped only after the original dog has been received by the breeder and documents from a
qualified veterinarian are verified stating that the original dog, in fact, does have a debilitating/life threatening condition.
18) I/We accept possession of the dog described below at Adopter's own risk and hereby expressly releases and waives any claim
or cause of action against WCK which Adopter may have now or in the future for any damages to person or property caused by said dog.
19) If, for some reason, there has been a report made of this dog being abused or mistreated, I/We agree that WCK or any authorized
individual acting on its behalf may examine or make inquiry about the pet at any time, with or without notice to Adopter. If said
examination or inquiry demonstrates that the dog is not being cared for in a manner wholly consistent with the above representations
and/or the representations made by Adopter on the Application submitted by Adopter, the Adopter agrees that WCK, or any authorized
individual acting on its behalf, may reclaim the dog and place it in another home without payment or compensation to Adopter. Adopter
hereby expressly authorizes and licenses an authorized individual (such as a law enforcement officer or licensed personnel from an animal
welfare protection agency) acting on WCK’s behalf to enter onto Adopter's property for the purposes of examining or making inquiry
about the dog and/or for the purpose of reclaiming the dog. This does not give WCK or any person other than a law enforcement
officer/licensed animal welfare personnel the right to go onto the adopter’s property.
20) In the event of any dispute hereunder relating to ownership on possession of the dog that is subject of this agreement the parties
agree that the dog shall be placed in the care and custody of the WCK until a determination by a court of competent jurisdiction.
By execution of this agreement the adopter hereby expressly consents to the removal of the dog by law enforcement from the adopter
and placement of the dog with WCK.
21) In the event of a dispute arising out of the terms and conditions of this Adoption Contract, and in the event that WCK prevails in
any legal proceedings initiated as a result of said dispute, then Adopter agrees to reimburse WCK for its reasonable attorney's fees and
expenses incurred as a result of the dispute.
22) Adopter understands and agrees that, in the event of a breach of this Agreement by Adopter, WCK does not have an adequate
remedy at law. Therefore, Adopter agrees that equitable relief in the form of a Temporary Restraining Order, preliminary and/or permanent
injunction is appropriate in the event that Adopter attempts to transfer the ownership or custody of the dog in violation of paragraph 9
above.
23) Any action to enforce this contract shall be carried out in Shelton, Washington.
24) When applicable, I/We agree to have the dog spayed/neutered by the time the pup reaches 6 months of age and I/We will provide
WCK with proof of such spaying/neutering.
25) I/We acknowledge that this dog has been micro-chipped using the AVID and is registered in the PETtrac Recovery System. I/We
agree to contact PETtrac Recovery System if any changes take place such as name, address or phone number and agree to pay the
required fee to update the information.
26) I/we understand that WCK has made every effort in their dogs producing healthy offspring through routine vet visits, x-rays of hips & elbows and registration with the Orthopedic Foundation of America. WCK has made every effort to assure that their dogs are of good quality hips and elbows, thus lowering the possibility of Hip Dysplasia. The Alaskan Malamute is a large breed dog, and therefore, at greater risk of this condition. Hip Dysplasia can be caused by several factors including genetics, over excessive growth and weight gain, as well as injury. Under these conditions, WCK guarantees against any Genetic Hip Dysplasia brought on by sire or dam for 2 years from the date of birth. If the condition is found to be genetic within two years of the dog’s date of birth, the dog may be returned and all moneys paid can go toward a comparable dog in price from a future litter. Documents by a certified veterinarian must verify the condition exists through genetics only and not from growth, weight or injury.
27) I understand and agree that if the puppy/dog needs to be transported by airlines to its owners destination, once it has been checked in at the airport, all responsibility of WCK will be relinquished and transferred over to sole responsibility of the new owner. I also acknowledge that the airline does not insure the animal other than the reimbursement of airfare and it is my responsibility to insure the puppy/dog using an outside insurance company if I choose to do so. WCK will not be held responsible for any reimbursement of the purchase of said dog above.
The following pertains only to breeders that WCK is working with:
28) I/We agree that we have purchased this dog for breeding purposes. If for any reason I/we choose not to keep this dog,
it shall be spayed/neutered before leaving my/our possession and WCK will be notified with appropriate documentation of the alteration.
29) I/We agree that this dog’s first and second generation of puppies shall be sold with limited registration only (no breeding rights
shall be given out on it‘s offspring or it‘s offspring‘s offspring until the third generation).
30) I/We agree that this dog shall not be sold or given to any other breeder other than myself. Failure to comply with this will result
in an immediate void of this contract and the dog and all accompanying paperwork related to the dog will be transferred back to WCK
without any further compensation and at buyer‘s expense.
This contract constitutes the full agreement and understanding of both parties. Wherefore, the above-named Adopter has executed
the foregoing contract of adoption at Willow Creek Kennel, Shelton, WA.
